1. Who you are agreeing with

These Terms of Service ("Terms") are a contract between you and Alexander Grigorov ("we", "us", "the Operator"), the operator of the WishScape mobile and web app (the "App"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy.

2. Eligibility

You must be at least 13 years old (or 16 if you live in a country where local law sets the digital-consent age higher) to create an account. If you are under the age of legal majority in your country, you confirm that a parent or legal guardian has reviewed these Terms with you.

3. Account responsibilities

You are responsible for keeping your password confidential and for any activity that happens under your account.

•

You agree to provide accurate information when you sign up (email, display name) and to keep it up to date.

•

One person, one account. Do not transfer your account to anyone else.

•

Tell us right away if you suspect somebody else has accessed your account.

4. Acceptable use — your content

You retain ownership of the wishes, gift ideas, lists, images, and other content you upload (your "Content"). By posting Content you grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, and transmit it strictly as needed to operate the App for you and the people you choose to share it with. The licence ends when you delete the content or your account, except where we have to keep a copy for backup, legal compliance, or abuse-investigation purposes.

You agree not to upload, post, or share Content that:

is illegal, defamatory, fraudulent, harassing, threatening, hateful, obscene, or sexually explicit, or incites violence;

•

impersonates another person, creates a fake identity to mislead, or misrepresents your affiliation with anyone;

•

infringes someone else's intellectual property, privacy, or publicity rights;

•

contains malware, phishing links, spam, or deceptive offers;

•

depicts minors in any sexual or exploitative way (we report such content to law-enforcement authorities and ban the account);

•

violates any applicable law or these Terms.

5. Acceptable use — community

WishScape is built around friend-to-friend wish-list sharing. To keep it that way:

•

Do not harvest, scrape, or otherwise collect data about other users beyond what the App's interface intentionally exposes.

•

Do not bypass the privacy levels set by other users on their wishes or wishlists.

•

Do not attempt to access another account or any part of the infrastructure we have not made public.

•

Do not use the App to send unsolicited commercial messages.

•

Do not abuse the friend-request, block, or report systems (e.g. mass reports of legitimate content).

6. Reporting and moderation — zero tolerance for objectionable content

We operate a zero-tolerance policy for objectionable user-generated content (hate speech, harassment, sexual content involving minors, threats of violence, impersonation, and spam, among others — see Section 4).

Any user can report another user or any user-generated content from inside the App. The report goes to our moderation queue.

•

We aim to review every report within 24 hours, take action where warranted (warning, content removal, account suspension, account termination, referral to authorities for illegal content), and notify the reporter of the outcome where practical.

•

Any user can also block another user from inside the App. Blocking removes the existing friendship, hides the blocked user from search and friend lists, and prevents future friend requests.

•

We may remove Content or terminate accounts at our sole discretion for any violation of these Terms.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which describes what we collect, how we use it, and your rights. You agree to that policy when you agree to these Terms.

8. Account suspension and termination

We may suspend or terminate your account if you violate these Terms, abuse other users, or compromise the integrity of the App. You may terminate your account at any time from inside the App (Profile → Danger zone → Delete account). Termination removes your account and Content from active systems; backups may persist for a limited period as described in the Privacy Policy.

9. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, secure, or virus-free. Your use of the App is at your own risk.

10. Limitation of liability

To the maximum extent permitted by law, the Operator and its agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the App; (b) any conduct or content of any third party on the App, including without limitation any defamatory, offensive, or illegal conduct of other users; or (c) unauthorised access, use, or alteration of your transmissions or Content.

In jurisdictions that do not allow these exclusions, our liability is limited to the amount you have paid us in the twelve months preceding the claim — for the free version that is zero.

11. Changes to the App and to these Terms

We may add, change, or remove App features at any time. We may also update these Terms; when we do, we will update the "Last updated" date above and announce material changes through the App or by email. Continued use after the effective date of an update is treated as acceptance of the revised Terms.

12. Governing law and disputes

These Terms are governed by the laws of the Czech Republic without regard to conflict-of-laws principles. Any dispute that cannot be resolved through good-faith negotiation will be brought in the courts of the Czech Republic, and you and we consent to the personal jurisdiction of those courts. Nothing in this section limits consumer-protection rights you have under the laws of your place of residence.
